Chandigarh. THE house of Shaheed Sukhdev, situated at Naughara Mohalla in Ludhiana , has been declared as a “protected monument”, stated the affidavit filed by Joint Secretary of Cultural Affairs, Archeology and Museums, Punjab, Ram Asra Garg.
The affidavit was filed by Garg in pursuant to a public interest litigation (PIL) filed by Advocate H C Arora. A PIL was filed by the advocate seeking issuance of directions to the State of Punjab to preserve and protect the ancestral house of martyr Sukhdev at Naughara Area, Ludhiana, as a monument by way of memorial for his supreme sacrifice.
The PIL was disposed of by the division bench comprising Chief Justice, V K Jain and Justice Mahesh Grover after Garg filed the affidavit. The affidavit reads "It is a historical fact that Shaheed Bhagat Singh, Rajguru and Sukhdev have made supreme sacrifices by kissing the gallows on March 23, 1931 for the cause of the Nation and to unchain the shackles of slavery".
 However, the relatives of Shaheed Sukhdev had not agreed with the Government to donate the house. The house has been declared as a protected monument under "The Punjab Ancient and Historical Monuments and Archeological Sites and Remains Act, 1964". However, recently, the department of Cultural Affairs, Archeology and Museums, Punjab, decided that the house should be protected and a preliminary notification was issued on May 17 under Section 4 (1) of the Act, inviting objections within 2 months regarding the declaration of the house as a protected monument. On the expiry of the said period of two months, the government shall consider the objections and then shall take appropriate decision as per law".
The division bench, after incorporating the above para in the affidavit, in its order, observed that in view of the stand taken by the state government, no further directions are required to be issued in the matter, and the writ petition is disposed as such.
